Minutes

August 28, 1996


Chesterfield, New Hampshire

Meeting began at 7:35 P.M.

Members Present:McKim Mitchell, Kathy Davidson, Tom Duston, Jeff Newcomer, Cliff Lerner, Kate Haines, and selectmen's representative Tim Butterworth.


Wetland Permit Applications:

  • Joslin :Expedited application received by McKim and reviewed prior to meeting by Kathy and McKim. McKim met with Mr. Joslin at the site and discussed the proposed project and tree cutting. (remove stone wall, excavate, and construct beach) McKim told Mr. Joslin that limited tree cutting was o.k. based on McKim's information, but the cutting cannot be near the water, cannot drop trees in the water, there may not be any soil disturbance by creating ruts, etc. unless the water area is protected. McKim received a phone call by a concerned abutter (Starbuck)on 8/28/96 stating that Mr. Joslin had removed the trees including some trees on abutter's property. McKim and Tim will visit the site on 8/29/96 and make recommendations. Tim will check with the wetland's board about regulations on shoreline property and cutting trees. McKim will copy the application and send the original to Mr. Joslin along with a letter stating that he should use the standard wetlands application form instead of the expedited one.

  • Klepacki: This application was dated 6/29/96, but was only received by the Town Clerk on 8/28/96. It will be suggested to the Town Clerk that all applications be stamped with a "Received on Date" for our information. This application was an expedited form for property on 78 North Shore Rd. tax map 5C-C4, with the contractor being Jack Clark. They are proposing to repair and replace existing retaining wall, with the wall being extended 20 feet. The board feels that this would require a standard form. Kathy will send a letter to the applicant with this information.

  • Folta: File #96-01419, 15 North Shore Road, Spofford. Project is for path and dock construction. Letter dated 8/7/96 from Wetlands Inspector, indicates that they require more information about dimensions of dock, and it's proposed location on the lake in relation to abutter's properties. Other information requested included type of material proposed for the path and side setback information. The Chesterfield Planning Board minutes dated 8/5/96 also indicate concerns with this project. The path proposed by the applicant is interpreted as more of a drive/roadway type of access. Planning board recommended that the Zoning Board be provided a copy of this application with concern noted that if the project qualifies as a driveway, it may be in violation of the side setback requirement.


Town of Chesterfield Public Works Department: An expedited form including four projects have already been sent to the state. The Planning Board indicated that Project #3 on Gulf Road utilizing rip rap might not be the best and least impacting solution. They recommended that we strongly examine and review the Town's application, yet did not make an alternative suggestion as to how the rip rap could be replaced.

There was some discussion about the expedited wetands applications, how they can be reviewed, etc. Kathy spoke with Tracy from the State Wetlands Office. The Wetland permitting process is somewhat changing. New forms are being developed and should be ready by September for our use. Changes were made in April of 1996 and a new manual is available to Commissions that will help them in reviewing application. It was determined that groups of four Conservation Commission members would review the applications and walk sites, etc. prior to our regular monthly meeting so the applications could be expedited more efficiently. Tom Duston will contact land owners getting their permission to walk their property and contact Commission members the Friday prior to meeting. The first meeting of Tom, Kate, Kathy and Jeff will be on Sunday, September 22, 1996 at 4:00 p.m. at the Town Offices.


A letter dated August 4, 1996 was received by the Selectment from Mr. Pacek re: alleged damage being done to trees around the town's highway garage and recycling center possibly due to the salt/dirt pile runoff. Brief discussion re: this complaint. Members will visit the site and other salt/dirt pile sites and discussion will continue at the September meeting.

Our next monthly meeting will be on Wednesday, September 25, 1996 at 7:30 p.m. at the Town Offices.

Note: Tom sent the trail inventory information to the state. Thanks Tom !! Agenda for September meeting will include:

  1. List of Goals and Objectives for the commission to develop
  2. Friedsam- signage, rules about trails, trash, general use of forest, etc.
  3. Introduction of board to new 7 & 8 grade science teacher suggested.
  4. Budget for 1997
